A recent legal case drew a lot of public attention in China. The case involved a person named Xu Ting and it happened in 2006 in Guang Zhou.

Xu went to an ATM to withdraw cash. He noticed that after withdrawing 1000 Yuan his balance was only lower by 1 Yuan. He thought he was lucky so he repeatedly withdrew money from the machine for 171 times and totally withdrew 175 thousand Yuan.

He ran away with the money and was captured by police one year later. He was sentenced to life in prison in court. How much 175 thousand Yuan worth? It is about 25 thousand dollars. 25 thousand dollars vs life in prison, does it make any sense at all?

I believe if it is in the United States Xu may get let less than a year’s jail time even he purposely stole 25 thousand from the bank let alone Xu had no plan at all to steal the bank’s money. It was just a Malfunction ATM that didn’t debit his account right and it was taken advantage by Xu. I personally think the case should not be trialed as criminal case at all.

Let’s imagine what it is going to be like in the United State. Assuming the amount withdrew is 175 thousand dollars instead of Yuan. He may probably get fine for an amount that is bigger than what he withdrew if the case is trialed in the US. If he spends all the money and can’t pay the fine he may file bankruptcy. He is definitely going to be a free person and after certain years he can be financially free also. If you are legal expert please let us know what the possible sentence of such case is in the US.

On another hand, in a high profile case involved Zhou Zheng Yi who was once doped the richest person of Shanghai, Zhou was sentenced to jail for only a few years. He was convicted falsifying corporate financial document and manipulating stock price of the public companies he was in control. If the law is fair for everyone then Zhou probably would be sentenced to die.

China’s economy is doing very well and I think the government really did a good job on that but there are a lot of dark side especially the law enforcement system. It doesn’t have enough respect to human rights and the legal enforcement force itself doesn’t have enough understanding of laws.

Of course China is improving. China is becoming more and more open. I believe as long China keeps it openness. The public force will put the development of the society on the right track.
